In the complementary care field, professional associations require from the legal framework that a therapist works with a treatment agreement. A treatment agreement is basically another word for General Terms and Conditions of a regular company or an online shop. 

The ordering process of services starts with the creation of an account because we need your details to draw up a fully completed treatment agreement. In this, you also give us permission to use your e-mail address in accordance with the AGV privacy legislation. As it concerns confidential client data, we are obliged to work with 2FA. This abbreviation stands for two factor authentication. It is an extra login security with a code in addition to your user name and password.

You will receive an email in your inbox during the ordering process to place a digital signature with a mouse or with your finger on your smart phone. After digitally signing the personalised treatment agreement, you will receive a PDF copy in your inbox. Once payment is received and the treatment agreement is signed by you, the process to schedule an intake (online) starts.

Treatment agreement without your personal data

  • The therapist is obliged to act in accordance with legal regulations. The rights and obligations of a client and a counsellor are laid down, inter alia, in the Medical Treatment Agreement Act (WGBO), the Care Quality, Complaints and Disputes Act (Wkkgz) and the General Data Protection Regulation (AvG). See annex. The client has the right to inspect his/her own file. In accordance with the statutory retention period, the file is kept for a total of 20 years. For minors, the retention period starts from the eighteenth year of life. As an exception to the legal retention period, the client's files will be destroyed in the event of the therapist's sudden death. 
  • From the AvG it is possible that special personal data will be mentioned in the file as this may be important during treatment. Furthermore, personal data will be documented which are necessary for bookkeeping, declarations to health insurers and file creation. The care invoice you receive will include the data requested by the health insurer so that you can claim this invoice from your health insurer. Your name, address and place of residence + Your client number and/or date of birth + Insurance and/or policy number + The date of treatment + A brief description of the treatment + Performance code + The cost of the consultation.
  • The therapist will only initiate a treatment plan for an illness after a diagnosis has been made by a regular doctor. In the case of a coaching plan, this does not apply. 
  • The therapist will only perform treatment with children under the age of 16 in the presence of a supervisor (parent, carer or other responsible adult). The therapist working with children under the age of 16 will enter into a written treatment agreement with both parents. 
  • The client undertakes to cancel an appointment on time (at least 24 hours in advance), otherwise the consultation will be cancelled from the already paid treatment or coaching plan. Continuity of treatments and coaching is an important factor in the success of our treatment or coaching plan. Client will refrain from frequently rescheduling scheduled appointments - for whatever reason. For a treatment plan for an illness, it is necessary to actually treat 3 weeks consecutively. This does not apply to a coaching plan. 
  • The therapist undertakes to provide treatment-related information to the client at all stages of treatment. The client undertakes to provide all relevant information to the therapist through the intake interview. This includes any use of drugs, alcohol and medication. 
  • The therapist will observe confidentiality regarding the data provided by the client for the file (with the exception of data to which the client has declared that he/she does not object to their use for statistical purposes).
  • The therapist is not allowed to perform (operations) without the client's consent. Not even via remote treatment. 
  • Final results with guarantees can never be predicted. The therapist always strives for improvement and will only raise realistic expectations. Treatment and coaching will be continued by the therapist until sufficient results have been achieved or no further improvement can be expected. 
  • The therapist undertakes to correctly refer the client to a fellow therapist or doctor if his/her treatment is not appropriate and/or sufficient.
  • Termination of the treatment can take place by mutual consent at any time. If the client no longer appreciates or considers it necessary to continue the agreement, he/she may unilaterally terminate it. If the client terminates the agreement against the therapist's advice, the client shall, at the therapist's request, sign a statement in which the client indicates that he/she has prematurely terminated the treatment or coaching against the therapist's advice.
  • Client is aware that therapist's approach deeply affects old soul pains and as a result, intense emotional, vital and also physical pains may manifest. In this situation, mental thinking gives the impression that the treatment plan is not working. The situation seems to be seemingly worsening. Mental thinking is then very active and client may panic. Client should calmly wait until the storm has subsided, vitality returns and whether the worsened physical pains have disappeared.
  • Client is aware that by his attitude, comments and presence, therapist can represent persons from the past as if you are shooting back in time. As a result, traumas are triggered and very strong emotions surface during or after treatment. This can take weeks for these to subside. Stay with yourself and do not share these emotions with others. This makes the effect of the treatment even more powerful. People around you will not understand. And during this process, you are not yourself. It is as if the foundation you have been holding on to for years has been knocked out from under you. Realise that the emotions (anger, attachment, jealousy, pride and insecurity) can be very intense. Trust that you can handle this. Furthermore, you will contact therapist first in case of panic situations.
  • Be aware that when dealing with trauma, you are thrown completely back on yourself and observe your mental thinking carefully. As soon as you go through past trauma, your mental thinking is far from calm. Chances are you will get angry with the therapist. This is a projection. From panic, depression or very low vitality, you may prefer another therapist or want to take a break. You want to slow down or even stop the treatment plan. This is what your mental saboteur desires. This is your inner struggle between head and heart. This is not your soul wishing for relief from pain and sorrow. Observe yourself carefully and always seek advice from the therapist first.
  • If client chooses to immediately consult the (general) doctor after a treatment due to worsening symptoms in a clinical picture and, on his or her advice, to take a course of antibiotics or painkiller injection, or to go to a physiotherapist or chiropractor, client is aware that this does not stimulate the client's self-healing capacity. Therapist should then start a new series of treatments from the outset. Client always declares to first inform therapist about this in order to discuss the situation. For life-threatening illnesses such as pneumonia, the client must at all times follow the (GP's) advice regarding antibiotics. 
  • The therapist can only unilaterally terminate the agreement, stating arguments, if he cannot reasonably be required to continue the agreement. In such a situation, the therapist will continue to provide help and advice until the client/applicant has been able to conclude an agreement with another care provider.
  • Payment method for treatments within a treatment plan or coaching plan is by bank prior to commencement. The obligation exists after signing this treatment agreement. If the client fails to start or complete the treatment plan or coaching plan, there will be no refund. Additional insured persons who do not opt for a treatment plan are also subject to the obligation to pay in advance by bank and to sign a treatment agreement. The refund option does not apply in any case, as payment is made on a one-off basis. All extrajudicial collection costs related to the collection of the declared amounts shall be borne by the client.
  • For any complaints about the treatment, the client can turn to the independent complaints officer of the professional organisation. The client can also turn to the Disciplinary Tribunal for the Natural Health Professions Foundation (TCZ).
  • The client declares to have taken note of the privacy statement. 
  • The therapist is required to have business liability insurance.
  • If the performance of an assignment by the therapist leads to liability, such liability will always be limited to the amount paid out by the insurer in the case in question under the therapist's applicable liability insurance policy, to be increased by the amount of the excess payable by the therapist under the applicable insurance policy in the case in question. 
  • If for whatever reason no payment should be made under the insurance referred to in Article 11, any liability shall be limited to an amount of the fees charged and paid, excluding VAT, in the relevant calendar year in the case concerned.
  • Without prejudice to the provisions of article 6:89 of the Civil Code, the right to compensation for damages expires in any case twelve months after the event from which the damages arise directly or indirectly and for which the therapist is liable. The above provisions in articles 30 and 31 also apply if any third party claims damages on the basis of a right acquired or taken over from the client and/or another. 
  • The client indemnifies the therapist against claims by third parties, who claim to have suffered damages due to or related to the work performed by the therapist on behalf of the client. 
  • By signing this agreement, the client expressly agrees that the invoice regarding the proposed treatment plan or per consultation in the case of additionally insured persons may be sent by mail to the following mail address:  
  • If the e-mail address reported changes, the client will inform the therapist as soon as possible in connection with possible additional treatment plans or coaching plans.
